Terms of Service — IPTAS

1. Acceptance
By creating an account or using IPTAS ("the app", "the service") you agree to these Terms. If you don't agree, don't use the service.
IPTAS is owned and operated by Guerrilla Consulting Ltd ("we", "us", "our"), a company incorporated under the laws of British Columbia, Canada. These Terms are a contract between you and Guerrilla Consulting Ltd. IPTAS is a fully-online service operated remotely; we do not maintain a public mailing address. The IPTAS product operates as a standalone service; references in these Terms to "we", "us", or "our" mean Guerrilla Consulting Ltd as the legal entity behind it.
2. Eligibility
You must be at least 13 years old to use IPTAS. If you're between 13 and 18, you confirm a parent or legal guardian has reviewed and accepted these Terms on your behalf.
You must provide accurate information during signup and keep it current.
3. The service
IPTAS is an AI-powered fitness coaching app. Core features include:
- AI-generated workout, meal, and stretching plans tailored to your inputs
- A conversational AI coach that responds to your messages and reacts to your logged data
- Logging tools for workouts, meals, body metrics, cardio, hydration, soreness, mobility, and progress photos
- Notifications based on your activity
- A free tier with caps on AI use, and a paid Pro tier with expanded access (see Section 8)
4. No medical, dietary, or therapeutic advice
THIS SECTION IS IMPORTANT. PLEASE READ IT CAREFULLY.
IPTAS provides general fitness, nutrition, and wellness information generated by an AI model based on the inputs you provide. The content of the app — including AI-generated workout plans, meal plans, stretching plans, macro targets, coaching messages, form reviews, recipe ideas, notifications, and any other output — is for informational and educational purposes only. It is NOT medical advice, dietary advice, therapeutic advice, mental-health advice, diagnosis, treatment, or any other form of professional advice.
IPTAS is not a healthcare provider
Guerrilla Consulting Ltd is not a licensed medical practitioner, registered dietitian, certified personal trainer, physical therapist, psychologist, or any other licensed health professional. The in-app AI coach is a software model, not a person, and is not licensed to practice medicine, nutrition, physical therapy, mental-health care, or any other regulated health profession in any jurisdiction. No information in the app should be relied upon as advice from a qualified professional.
Always consult a qualified professional before
- Starting any new exercise or fitness program
- Making any change to your diet, including supplements
- Acting on any nutrition, training, or recovery suggestion from the app
- Beginning or stopping any medication, supplement, or treatment
- Beginning or modifying a program if you are pregnant, postpartum, or breastfeeding
- Beginning or modifying a program if you have or suspect any medical condition — including but not limited to heart disease, diabetes, hypertension, joint or musculoskeletal injury, asthma or other respiratory conditions, eating disorders, neurological conditions, or mental-health conditions
- Beginning or modifying a program if you are recovering from injury, surgery, or illness
- Using the app if you are under 18 (parental / guardian guidance is required — see Section 2)
Stop exercise and seek medical attention if you experience
- Chest pain, pressure, or tightness
- Shortness of breath beyond normal exertion
- Dizziness, lightheadedness, or fainting
- Sudden, severe, or unexplained pain
- Unusual fatigue or weakness
- Any symptom that feels wrong or out of the ordinary
If any symptom is severe, persistent, or accompanied by other concerning signs, contact emergency medical services. Do not rely on the app for acute medical guidance.
AI output may be wrong, incomplete, or inappropriate for you
The AI does not have access to your medical chart, does not observe you in person, and cannot perform diagnostic tests. Its recommendations are probabilistic, generated from patterns in training data — not from a clinical evaluation of you specifically. Output may contain factual errors, outdated information, or recommendations that are unsafe given your particular medical history. Always apply your own judgment and the advice of qualified professionals before acting on anything the app produces.
The in-app coach will redirect medical questions
The AI coach is instructed to redirect medical, diagnostic, and treatment-related questions to qualified professionals. We do not diagnose conditions, prescribe medications or supplements, treat or manage any medical condition, or provide therapy or counseling. If you ask the coach a question that requires a clinical opinion, the coach is designed to refer you to a doctor, dietitian, physical therapist, or other appropriate professional.
You assume all risk
By using IPTAS you acknowledge and agree that:
- You assume all risk associated with your use of the app and any content it produces, including risk of injury, illness, aggravation of existing conditions, or any other loss.
- You are solely responsible for evaluating the safety and appropriateness of any plan, suggestion, or coaching message for your specific medical, physical, and lifestyle situation, and for consulting a qualified professional whenever appropriate.
- We disclaim all liability for injury, illness, or other harm arising from your use of, or reliance on, any content the app produces (see Section 12 for the full liability limit).
- You will not use IPTAS as a replacement for medical, nutritional, or therapeutic care from a licensed professional, and you will seek professional care for any condition that warrants it.
By creating an account or using IPTAS you confirm that you have read this section and accept that the service is informational, not medical, and that any decision to act on the app's content is yours alone.
5. Your account
You're responsible for:
- Keeping your login credentials confidential.
- Activity that happens under your account.
- Ensuring you have the right to upload any content (photos, etc) you put into the service.
You can delete your account at any time via Settings → Delete account. Deletion removes all data we hold about you within 30 days (see Privacy Policy).
We may suspend or terminate your account if you violate these Terms, abuse the service (e.g. attempting to circumvent rate limits or gain unauthorised access), or misuse the AI in ways prohibited by our AI provider's policies.
6. AI processing
The in-app coach is powered by a third-party AI model (currently Claude from Anthropic). When you use any AI-powered feature we send your context — profile, recent logs, the current message — to the provider. See the Privacy Policy for details.
You agree that:
- AI output is generated; it may contain errors.
- We don't guarantee the accuracy, completeness, or fitness for any particular purpose of any AI-generated content.
- You will not attempt to extract, manipulate, or jailbreak the AI model.
- You will not use IPTAS to generate harmful content (medical misinformation, abusive language, content targeting minors, etc). We may terminate accounts that do.
7. Acceptable use
Don't:
- Reverse-engineer or decompile the app
- Scrape or systematically extract content
- Resell, sublicense, or share account access
- Use IPTAS for commercial coaching of third parties (you may not rebrand the AI's output as your own coaching service)
- Upload illegal content or attempt to exfiltrate other users' data
- Bypass tier limits or feature gates
- Use automated tools (bots) to interact with the service
- Use the service in ways that violate applicable law
8. Subscriptions and billing
IPTAS offers a free tier with caps on AI usage and a Pro tier with expanded access. Pricing is shown in-app and in the App Store / Google Play listing.
- Subscriptions are managed by Apple App Store or Google Play. We do not see or store your payment information.
- Auto-renewal: Pro subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period. Cancel via the relevant App Store / Play subscription settings.
- Refunds: handled by Apple or Google per their refund policy. We don't issue refunds directly.
- Pro features are listed at IPTAS.app/pricing and inside the app under Subscription. We may change features in either tier by giving you advance notice; if a change materially reduces what you paid for, you can cancel and request a pro-rata refund through Apple or Google.
Free tier limits (chat messages, photo logs, etc) reset on a daily, weekly, or monthly schedule. Limits and the features behind the Pro gate are subject to change.
9. Your content
You retain ownership of content you put into IPTAS (photos, descriptions, notes, etc). You grant us a limited, non-exclusive, royalty-free licence to host, process, and display that content only for the purpose of running the service for you — we do not use your content for advertising, training third-party models, or any unrelated purpose.
We may anonymise and aggregate usage data for product improvement. This data cannot be linked back to you.
10. Our content
The app's design, code, copy, the in-app coach's voice and persona, and any branded assets are owned by us. You get a limited, non-transferable, revocable licence to use them for your personal, non-commercial benefit while your account is active.
11. Service availability
We aim for high availability but make no SLA. The service may be temporarily unavailable for maintenance, network issues, AI provider outages, or other reasons. We're not liable for losses caused by downtime.
12. Disclaimers and liability limit
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT.
TO THE FULLEST EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, injury, illness, or data loss, arising from your use of the service.
- Our total liability for any claim relating to IPTAS is limited to the amount you paid us in the 12 months preceding the claim, or CAD $100 (one hundred Canadian dollars) if you used the service for free.
Some jurisdictions don't allow these limits. To the extent they apply to you, our liability is limited to the maximum permitted by law.
13. Indemnity
You agree to indemnify us against any third-party claim arising from:
- Your breach of these Terms
- Your misuse of the service
- Content you upload that violates someone else's rights
14. Changes to these Terms
We may update these Terms. Material changes will be notified in-app and via email at least 30 days in advance. Continued use after the effective date constitutes acceptance. If you don't accept, delete your account.
15. Governing law and disputes
These Terms are governed by the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable in British Columbia, without regard to conflict-of-law principles. Disputes arising under or in connection with these Terms or your use of IPTAS will be brought exclusively in the courts of Vancouver, British Columbia, and you and Guerrilla Consulting Ltd consent to the personal jurisdiction of those courts — except where required otherwise by your local consumer-protection laws.
For US users: nothing in these Terms waives your right to bring an action in small-claims court.
For EU/UK users: nothing in these Terms limits your statutory consumer rights, including your right to a refund for defective digital content.
16. Severability and entire agreement
If any provision is found unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy and any in-app disclosures, constitute the entire agreement between us.
